Fuel Finder, Route Optimisation and MOT Map — Terms of Use

1. About these Terms
These Terms of Use (Terms) govern your access to and use of Quartix’s Fuel Finder, Route Optimisation and MOT Map service, including its websites, mobile-optimised pages, mobile applications, customer portals, saved-route and account features, application programming interfaces (APIs), embedded versions, and any updated, replacement or successor version (together, the Service).
The Service is provided by Quartix Limited, a company incorporated in England and Wales with company number 04159907, whose registered office is at Quartix, New Church Street, Newtown, Powys, Wales, SY16 1AF (Quartix, we, us or our). Contact us at [email protected].
By selecting “Accept and continue”, or by accessing or using the Service, you agree to these Terms. If you do not agree, you must not access or use the Service.
2. Important information
Fuel prices, station details, route suggestions, journey times, distances, traffic information, maps, location information and MOT-station information are provided free of charge for general information purposes only. They may be delayed, incomplete, unavailable, inaccurate or out of date.
You must check information independently before travelling, purchasing fuel or booking an MOT. In particular, confirm directly with the relevant provider the fuel price, fuel availability, opening hours, station facilities, MOT-station details, vehicle-test class, operating status and appointment availability.
The Service is not navigation, road-safety, driving, legal, regulatory, financial or professional advice. It is not a substitute for official road signs, traffic restrictions, road conditions, safe-driving practices or your own judgment.
You must not view, interact with or use the Service while driving. You remain responsible for ensuring that any route is lawful, safe and suitable for your vehicle, load and circumstances, and for complying with all applicable laws.
3. Intended business use
The Service is intended principally for use in connection with a trade, business, craft or profession. By accepting these Terms, you confirm that you use the Service wholly or mainly for those purposes and, where relevant, that you have authority to accept these Terms on behalf of the business you represent.
Quartix may ask for business information and may carry out reasonable checks against public or commercial registers. We may suspend or restrict access where information is incomplete, inaccurate, cannot reasonably be verified, or where we reasonably believe that the Service is being used unlawfully, improperly or other than for business purposes.
If you access or use the Service as a consumer, these Terms apply only to the extent permitted by applicable law. Nothing in these Terms excludes, limits or restricts any statutory rights or remedies that cannot lawfully be excluded, limited or restricted.
4. Service and data
The Service may contain or use fuel-price, fuel-station, route, traffic, distance, estimated journey-time, mapping, location, road-network, MOT-station and other data supplied by Quartix, public authorities, open-data providers, OpenStreetMap contributors and other third parties (Service Data).
The Service and Service Data are supplied on an “as is” and “as available” basis. Quartix does not guarantee that they will be accurate, complete, current, available, uninterrupted, secure, error-free, suitable for your purpose or compatible with your devices, systems or network.
Without limitation, fuel prices and availability can change after information is reported or displayed; route calculations, distances and journey times are estimates only; routes may not reflect traffic, roadworks, closures, official signs, restrictions, access rights, road conditions, height, weight, width, vehicle-type, hazardous-goods, emissions-zone or load restrictions; and MOT-station information may not reflect recent changes to operating status, authorisations, contact details or booking availability.
5. Availability and changes
We may change, update, correct, remove, suspend, restrict or withdraw all or part of the Service or Service Data at any time. We do not guarantee that the Service will always be available or free from interruption, defects, viruses or other harmful components. We are not obliged to maintain, support, update or correct the Service or Service Data.
6. Permitted use
Subject to your compliance with these Terms, Quartix grants you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable right to access and use the Service for your internal business purposes.
You must not:
- use the Service for any unlawful, fraudulent, malicious, unsafe or unauthorised purpose;
- use the Service while driving or in a way that distracts a driver;
- interfere with, damage, disrupt, overload, impair or attempt to gain unauthorised access to the Service, its systems, networks, accounts or data;
- introduce viruses, malware, ransomware, harmful code or other harmful material;
- use bots, spiders, scrapers, crawlers, scripts, automated tools, data-mining tools or similar technology to access, copy, extract, monitor or collect Service Data without our prior written permission;
- copy, reproduce, download, republish, distribute, sell, licence, rent, lease, commercialise or otherwise exploit the Service or Service Data except as expressly permitted by these Terms or applicable law;
- create a database or dataset from any part of the Service or Service Data;
- remove, obscure or alter any copyright, trade-mark, attribution, licence or proprietary notice; or
- reverse engineer, decompile, disassemble or attempt to derive source code from the Service, except to the extent applicable law prohibits that restriction.
7. Intellectual property, sources and third parties
Quartix and its licensors own or control the intellectual-property rights in the Service, including Quartix’s software, branding, user interface, design and Quartix-created content. Third-party, public-sector and open-source data remains subject to the rights, licences, terms, notices and attribution requirements of the relevant provider. You must not remove, obscure or alter those notices.
The Service may include OpenStreetMap road-network data and use Open Source Routing Machine (OSRM) software. Applicable OpenStreetMap attribution and Open Database Licence (ODbL) notices will be displayed in the Service. The Service may also use public-sector information under applicable open-data licences. Relevant data sources, licences and attributions are identified within the Service.
The Service may link to, display or rely on third-party websites, services, maps, routing, traffic, location or other content. Quartix does not control and is not responsible for their availability, accuracy, completeness, legality, security or suitability.
8. Liability
Nothing in these Terms excludes or limits Quartix’s liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.
Subject to that paragraph and to the maximum extent permitted by law, Quartix excludes all warranties, representations, conditions and other terms, whether express, implied, statutory or otherwise, including as to accuracy, availability, satisfactory quality, fitness for a particular purpose, non-infringement and uninterrupted operation.
Subject to the first paragraph of this clause, Quartix shall not be liable for any loss or damage arising from or in connection with use of, inability to use, or reliance on the Service or Service Data; inaccurate, incomplete, delayed, unavailable or out-of-date Service Data; fuel prices, fuel availability, fuel purchases, route decisions, journey times, road conditions, vehicle operation, MOT-station information, MOT bookings or third-party acts or omissions; or any loss of profits, revenue, sales, business, business opportunity, goodwill, reputation, anticipated savings, data, contracts, time, management time or use.
Subject to the first paragraph of this clause, Quartix shall not be liable for indirect or consequential loss or damage. For users acting in the course of a business, Quartix’s total aggregate liability arising out of or in connection with the Service or these Terms shall not exceed £100.
9. Privacy and cookies
Our processing of personal data is described in our Privacy and Cookie Policy. Where consent is required for non-essential cookies or similar technologies, we will obtain it separately; acceptance of these Terms is not cookie consent.
10. Suspension and termination
We may suspend, restrict or terminate access to the Service if we reasonably believe that you have breached these Terms, provided inaccurate or misleading information, created a security, legal, operational or reputational risk, infringed another person’s rights or exposed Quartix, its licensors or suppliers to actual or potential liability. On suspension or termination, your right to use the Service ends immediately.
11. General
We may update these Terms from time to time. The current version will be made available through the Service and will state its effective date. Where a change is material, we may require you to accept the updated Terms before continuing to use the Service.
If any provision is invalid, illegal or unenforceable, it shall be modified to the minimum extent necessary or treated as deleted. The remaining provisions will continue in full force. A delay or failure by Quartix to exercise a right does not waive that right. These Terms do not create rights enforceable by any third party, except that Quartix’s licensors and suppliers may enforce provisions intended to protect them where permitted by law.
12. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them or the Service are governed by the law of England and Wales. The courts of England and Wales shall have exclusive jurisdiction, except that consumers may benefit from mandatory protections and rights to bring proceedings in the courts of their country of habitual residence.
